Boat Rental Agreement

Mountain View Marina at Bear Paw herein after called  Marina does hereby rent to   RENTER herein after called   Renter one boat described as   BOAT_NAME on   DATE for   DURATION at a rate of   RATE plus tax. Renter agrees to have received the boat full of fuel and agrees to replace all fuel used during the rental period returning to the fuel dock no later than   RETURN_TIME.

The Renter understands how to safely operate the boat including the location and use of all safety equipment. The Renter's party consists of  ADULT_NUM adults and  CHILDREN_NUM children. All of whom have been given a life jacket of the appropriate size. The Renter understands the legal requirements to operate a boat in North Carolina and ensures that all boat operators meet those requirements.

The Renter acknowledges that the boat is the rightful property of the Marina, and further acknowledges that they received said boat in good and safe mechanical condition. The Renter agrees to return said boat together with all accessories to the Marina in the same condition as the Renter received it. Said boat is equipped with life jackets, a throw cushion, paddle, fire extinguisher, horn, ladder, a map and a full tank of fuel.

The Renter agrees to pay to the Marina the cost of replacing lost equipment and the cost of repairing damages to, and caused by, the boat including parts, labor expenses of transporting said vessel or other property to and from point of repair, all towing charges, including, but not limited to all towing charges as a result of grounding or beaching of the boat, regular rental fee covering time said vessel is out of service as a result of damage, and any collection cost and/or attorney fees necessary to secure reimbursement.

This agreement shall be interpreted under the laws of the State of North Carolina. Any litigation under this agreement shall be resolved in the courts of Cherokee County, State of North Carolina.

If any provision of this Contract is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Contract shall remain in full force and effect.

Policies and Restrictions
 - Boat is to be used by the renter for recreational purposes only.
- No pets are allowed on the boat.
- No cooking is allowed on the boat.
- The boat must be moored at the marina when not in use. Mooring the boat to private docks or to the shoreline often results in damage and is strictly prohibited.
- All Federal, State and Tennessee Valley Authority (TVA) regulations must be followed.
- A late return fee of $20 for each 15 minute period past the agreed upon return time will be assessed.
- Additional cleaning fees may be assessed if the boat is not returned in clean condition free of trash and mud.
- Boat rental fee is non-refundable. Rain checks may be given for full or partial credit at the sole discretion of the Marina.
